These Terms and Conditions (“Terms”) govern your access to and use of the public websites and virtual tours operated by Donahue Media Group LLC, doing business as Skyway Interactive (“Skyway,” “we,” “us,” or “our”) on Skyway-owned domains. By accessing or using the Sites, you agree to these Terms.
These Terms apply to visitors of Skyway-owned websites and virtual tour subdomains, including skywayinteractive.com and tour subdomains such as skywayvr.com, suiteview.com, greekview.com, birdieview.com, athleticview.io, and skyway.tours (collectively, the “Sites”).
Skyway also hosts virtual tours on subdomains controlled by our clients. When you visit a tour on a client-controlled subdomain, the terms posted by that client apply to your visit. These Terms do not govern your visit to those client-owned domains, even though Skyway operates the underlying infrastructure on the client’s behalf.
Skyway provides services to business clients under separate contracts. The rights and obligations of paying clients — including payment, deliverables, intellectual property in client-provided materials, service levels, and confidentiality — are governed by those contracts, not by these public Terms.
Eligibility
The Sites are not directed to children under 13, and we do not knowingly permit children under 13 to use the Sites. If you are between 13 and the age of majority in your jurisdiction, you may use the Sites only with the involvement of a parent or legal guardian.
Use of the Sites
You agree to use the Sites only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use of the Sites by others. You agree not to:
- Use the Sites to violate any applicable law or regulation
- Attempt to gain unauthorized access to any portion of the Sites, related systems, or networks
- Interfere with or disrupt the operation of the Sites, including by introducing viruses, malware, or other harmful code
- Use automated means (including bots, scrapers, or crawlers) to access the Sites in a way that imposes an unreasonable load on our infrastructure
- Reproduce, distribute, or create derivative works from content on the Sites without permission, except as expressly permitted by these Terms or applicable law
- Impersonate Skyway, another person, or otherwise misrepresent your affiliation
Intellectual Property
The Sites and their content — including the design, layout, text, graphics, photography, video, and the virtual tours themselves — are owned by Skyway or its clients and licensors and are protected by copyright, trademark, and other applicable laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Sites without our prior written consent.
“Skyway Interactive” and related logos and marks are trademarks of Donahue Media Group LLC. Trademarks of clients featured in virtual tours remain the property of their respective owners.
Copyright Concerns
If you believe content on the Sites infringes your copyright or other intellectual property rights, please contact us at jake@skywayinteractive.com with a description of the alleged infringement, the specific URL where the content appears, and your contact information. We will investigate promptly and take appropriate action.
Third-Party Links
The Sites may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party site or service, and including a link does not imply endorsement. Your use of third-party sites is governed by their own terms and policies.
Disclaimer of Warranties
THE SITES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SKYWAY DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Sites will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any content on the Sites is accurate, complete, or current.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SKYWAY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITES.
Because the Sites are provided to visitors free of charge, our total liability to you for any claims arising out of or relating to your use of the Sites will not exceed one hundred U.S. dollars ($100). The limitations in this section do not apply to liability that cannot be excluded or limited under applicable law.
This section addresses use of the public Sites. Liability for paid services is governed by the applicable client contract.
Indemnification
You agree to defend, indemnify, and hold harmless Skyway and its owner, operators, and agents from and against any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Sites.
Termination
We may suspend or terminate your access to the Sites at any time, with or without notice, for any reason, including if we believe you have violated these Terms. The provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Sites will be brought in the state or federal courts located in Clark County, Washington, and you consent to the jurisdiction of those courts.
Informal Dispute Resolution
If you have any concern or dispute about the Sites, you agree to first contact us at jake@skywayinteractive.com and attempt to resolve the matter informally before pursuing formal legal action.
U.S. Legal Compliance
You represent and warrant that you are not located in a country subject to U.S. government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.
Severability and Waiver
If any provision of these Terms is held unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last Updated” date above. Material changes will be communicated through reasonable means; for material changes, we will make reasonable efforts to provide at least 30 days’ notice before the new Terms take effect. Your continued use of the Sites after changes take effect constitutes acceptance of the updated Terms.
